Disney On Verge Of Getting $1B FCA Enviro Suit Nixed

Law360, Los Angeles (August 2, 2013, 4:00 PM EDT) -- A California federal judge on Friday tentatively tossed a $1 billion lawsuit accusing The Walt Disney Co. of polluting water near its Burbank, Calif., production facilities, saying the plaintiffs failed to allege how Disney defrauded the U.S. government under the False Claims Act.

At a hearing, U.S. District Judge Dolly M. Gee noted that even if relator RBC Four Co. LLC sufficiently pled that alleged false statements made by Disney to federal officials, it did not necessarily show the company was harmed by those purported statements....
