10th Circ. Asks For CAFA Ruling In BofA Foreclosure Suit

Law360, New York (August 13, 2013, 5:23 PM EDT) -- The Tenth Circuit on Tuesday asked a lower court to determine whether the Class Action Fairness Act gave federal courts the authority to hear a putative class action alleging that a Bank of America Corp. unit improperly foreclosed on Utah homes.

In its 18-page ruling, the Tenth Circuit said that it was unclear whether CAFA gave federal courts jurisdiction over the case against ReconTrust Co. NA, a Bank of America subsidiary that helps process nonjudicial foreclosures. The lower court had dismissed the case in February 2012...
