Wells Fargo Ducks Class Cert. In Loan Discrimination Suit

Law360, New York (August 15, 2013, 6:06 PM EDT) -- A California federal judge on Wednesday declined to certify a class of Wells Fargo Bank NA home loan refinancing applicants who were allegedly subjected to illegal age discrimination, saying two would-be borrowers failed to show they could accurately identify other class members.

U.S. District Judge William Alsup ruled that a suit targeting Wells Fargo’s alleged policy of excluding retirement account income from its calculation of earnings in loan modification requests from borrowers under 59 1/2 years of age hadn't met federal class certification requirements.
