Comcast Doesn't Change Cert. In Sears Washer Row: 7th Circ.

Law360, Los Angeles (August 22, 2013, 8:33 PM EDT) -- The Seventh Circuit on Thursday reinstated its earlier ruling in support of class certification in two class actions against Sears, Roebuck & Co. over allegedly defective washing machines, shortly after the U.S. Supreme Court vacated and remanded the case in light of Comcast Corp. v. Behrend.

The decision comes almost three months after the high court granted a petition for certiorari from Sears, vacated the Seventh Circuit’s 2012 decision and remanded the case to the appeals court for further consideration. The Supreme Court instructed the appeals...
