Texas High Court Finds Coverage For $6M Voluntary Payments

Law360, New York (August 23, 2013, 8:39 PM EDT) -- The Texas Supreme Court on Friday unanimously upheld a jury verdict that put Markel American Insurance Co. on the hook for the more than $6 million Lennar Corp. voluntarily spent to replace defective imitation stucco siding.

Parting ways with the intermediate appeals court, the Texas high court found that Markel's $25 million umbrella policy should foot the cost of Lennar's remediation program even though the homebuilder offered to repair the homes without first getting the insurer's blessing.
