Texas High Court To Hear Builder's Fight With Houston Port

Law360, Houston (August 23, 2013, 5:16 PM EDT) -- The Texas Supreme Court agreed Friday to weigh in on whether the terms of a wharf construction deal prevent contractor Zachry Construction Corp. from recovering $20 million for delays allegedly caused by the Port of Houston Authority.

The high court granted the contractor's petition for review of a lower appeals court’s decision that a “no-damages-for-delay” clause in the contract inoculated the port from legal claims.
