DR Horton Leans On 9th Circ. Ruling In Class Waiver Battle

Law360, New York (August 26, 2013, 5:46 PM EDT) -- The Ninth Circuit has become the third circuit court to reject a National Labor Relations Board ruling that mandatory arbitration pacts banning employment-related class actions are invalid, D.R. Horton told the Fifth Circuit on Thursday, looking to bolster its challenge to the NLRB decision.

With its Aug. 21 decision, the Ninth Circuit joined the Second and Eighth circuits in snubbing the NLRB's January 2012 D.R. Horton decision, the homebuilder said in a letter to the Fifth Circuit, where D.R. Horton is appealing the ruling.
