5th Circ. Refuses To Merge Faulty-Drywall Appeals

Law360, New York (September 3, 2013, 7:08 PM EDT) -- The Fifth Circuit on Tuesday rejected plaintiffs' request to consolidate for oral argument Taishan Gypsum Co. Ltd.’s separate appeals of a ruling that allowed numerous suits over defective drywall to go forward against the Chinese company.

Class action plaintiffs asked the circuit court to combine three cases on Aug. 22, arguing that Taishan's separate appeals all hinge on the same central question of whether the multidistrict litigation court has jurisdiction over the Chinese company.
