9th Circ. Reverses Class Win In Medicare Reimbursement Row

Law360, New York (September 4, 2013, 6:38 PM EDT) -- The Ninth Circuit ruled Tuesday that a challenge to the U.S. government's policy of demanding upfront reimbursement of conditional Medicare payments was not ripe for judicial review, reversing a lower court judgment in favor of a class of Medicare beneficiaries.

In a May 2011 decision, U.S. District Judge David C.
