Dukes Should Bar Cert. Of YMCA Race Bias Class: Judge

Law360, New York (September 6, 2013, 1:48 PM EDT) -- An Illinois federal judge on Thursday recommended the denial of class certification to employees suing the National Council of Young Men's Christian Associations over policies they say prevent black workers from being promoted, saying the class did not meet the heightened certification standards of the U.S. Supreme Court's Dukes decision.

U.S. Magistrate Judge Arlander Keys advised District Judge John J. Tharp Jr. against certifying the class because the employees had not submitted evidence that the nonprofit had a uniform discriminatory policy that had the same impact...
