Hartford Urges 7th Circ. To Remove $18M TCPA Coverage Row

Law360, Chicago (September 10, 2013, 8:13 PM EDT) -- Hartford Casualty Insurance Co. on Tuesday pressed the Seventh Circuit to bring a coverage suit arising from the $17.8 million settlement of a junk fax class action back to federal court, claiming the plaintiff resorted to tricky pleading to avoid federal jurisdiction.

In June, a federal judge remanded Addison Automatics Inc.‘s suit against the insurer to Illinois state court, finding that the coverage suit was not itself a class action and thus not subject to federal jurisdiction under the Class Action Fairness Act. Hartford then appealed...
