Quest Diagnostics Ducks ERISA Suit Over Severance Benefits

Law360, New York (September 11, 2013, 6:03 PM EDT) -- A New Jersey federal judge on Wednesday dismissed for lack of standing a putative class action alleging Quest Diagnostics Inc. systematically denied employees severance benefits under a so-called voluntary separation plan in violation of the Employee Retirement Income Security Act.

U.S. District Judge Dennis Cavanaugh granted Quest’s motion to dismiss plaintiff Zoe Mance’s suit alleging the medical testing company denied her severance benefits under Quest’s VSA plan, which she claimed she was eligible for and should have received even though she was fired.
