Calif. Court Revives Suit Against AT&T Over Obsolete Phone

Law360, Chicago (September 16, 2013, 5:26 PM EDT) -- A California appeals court on Friday revived a long-running putative class action accusing AT&T Mobility LLC of modifying its network in a way that rendered a certain high-end phone essentially useless, finding that the telecom company had waived its right to compel arbitration with class members.

The appeals court agreed with named plaintiffs Joshua Morgan and George Shannon that AT&T's waiver of arbitration rights applied not only to their claims as class representatives, but to the entire putative class as well, undercutting a lower court's denial...
