Text Message Antitrust Suit Not Exempt From AmEx Ruling

Law360, New York (September 18, 2013, 7:29 PM EDT) -- A federal judge ruled Monday that the U.S. Supreme Court's recent American Express Inc. decision prevented three messaging service companies from avoiding arbitration in their antitrust suit against a slew of wireless companies by arguing that the cost of pursuing arbitration would be prohibitive.

U.S. District Judge Alison J. Nathan ordered the bulk of a putative antitrust class action against AT&T Mobility LLC, Verizon Wireless LLC, Sprint Nextel Corp. and others into arbitration, ruling that claims of an antitrust conspiracy related to bulk commercial text messages...
