NJ Court Should Hear Chemical Spill Suit, Pa. Judge Rules

Law360, Los Angeles (September 26, 2013, 7:18 PM EDT) -- A Pennsylvania state court on Thursday sent a putative class action against Consolidated Rail Corp. over a November train derailment and resulting chemical spill to join similar suits being consolidated in New Jersey federal court.

Philadelphia Court of Common Pleas Judge Arnold New granted Conrail’s motion to dismiss the suit led by Allison Henry on the grounds it didn’t belong in Pennsylvania court because the accident occurred just over the Delaware River in New Jersey.
