Phone Users Seek Class Cert. In Text Service Suit

Law360, New York (October 4, 2013, 3:28 PM EDT) -- A California federal judge was asked Thursday to certify three classes in a suit accusing text message service providers of violating the Telephone Consumer Protection Act by surreptitiously enrolling consumers in monthly subscription plans.

The suit alleges a so-called cramming scheme by Wise Media LLC, Mobile Messenger Americas Inc., mBlox Inc., Motricity Inc. and m-Qube Inc. to enroll consumers — without their knowledge or consent — in short message service text subscription plans with monthly membership fees of $9.99.
