Law360, New York (October 4, 2013, 6:04 PM EDT) -- Network communications provider Windstream Communications Inc. was hit Friday with a proposed class action accusing it of violating the Telephone Consumer Protection Act by illegally calling residential phone lines to deliver a prerecorded message without the consent of the person being called.
Plaintiff Matthew Righetti alleges that Windstream Communications and Windstream Holdings Inc., which also provide broadband, phone and digital TV service to rural U.S. customers, called him Oct. 2 with one of the prerecorded messages.
