NJ Court Says University Email Is Protected In Firing Suit

Law360, New York (October 24, 2013, 7:35 PM EDT) -- A New Jersey appeals court on Thursday sided with Kean University in a whistleblower suit, ruling Kean does not have to turn over a privileged email that the university's former athletic director wants as evidence that he was fired for reporting a coach's regulatory violations.

A divided three-judge panel of the New Jersey Superior Court's Appellate Division reversed a judge's ruling compelling Kean to produce the email for Glenn Hedden, its former athletic director, who was terminated in 2011 for failure to properly supervise his subordinates....
