Law360, New York (October 25, 2013, 2:07 PM EDT) -- After previously failing to have claims against it dismissed, a New Jersey architecture firm on Thursday was finally tossed from a contractor's $3 million cost overrun suit filed against the Atlantic City Housing Authority over the construction of a housing project.
Senior District Judge Joseph E. Irenas finally granted Lindemon Winckelmann Deupree Martin Russell & Associates PC's motion for summary judgment, finding that SRC Construction Corp., which filed the complaint, had failed to present material evidence to prove Lindemon's negligence.
