Armored Car Co. Can Appeal 'Mixed Fleet' Worker's OT Status

Law360, New York (November 12, 2013, 10:49 PM EST) -- A New Jersey federal judge on Tuesday allowed Eastern Armored Services Inc. to appeal a ruling that the company had wrongly denied a driver overtime under the Fair Labor Standards Act, queuing up a Third Circuit opinion on a question that has split the district courts. 

U.S. District Court Judge Michael A. Shipp certified Eastern Armored’s motion for an interlocutory appeal, saying the case addresses a controlling question of law and should be addressed by an appellate court because significant differences of opinion still exist....
