Daimler Dismissed From Mercedes Defective Rims Suit

Law360, Los Angeles (November 13, 2013, 9:55 PM EST) -- A New Jersey federal judge on Friday dismissed putative class action claims against Daimler AG but preserved claims against subsidiary Mercedes-Benz USA LLC claiming the companies didn’t pay to repair defective rims in their cars, ruling that plaintiffs did not show Daimler set the cars’ warranties.

Plaintiffs filed suit in 2009 against Mercedes, claiming the luxury car company’s light alloy rims were too delicate to withstand normal driving conditions and that Mercedes refused to cover repair costs under its warranty. They added Daimler as a defendant...
