Continental Loses Bid To Apply Chinese Laws To Crash MDL

Law360, Los Angeles (November 19, 2013, 9:24 PM EST) -- A New York federal judge ruled Tuesday that state laws cover wrongful death claims filed in multidistrict litigation by a Chinese citizen whose wife was among the 49 people killed in a Continental Airlines Inc. crash near Buffalo in 2009.

U.S. District Judge William M. Skretny said New York laws apply to the damages claims, since the multidistrict litigation was filed in that state, as opposed to Chinese laws, which would limit damages that Xiaojun Pan may be entitled to receive.
