Appeals Court Says San Antonio Permit Law Can't Stand

Law360, Dallas (November 20, 2013, 7:38 PM EST) -- A Texas appeals court on Wednesday affirmed a lower court ruling that invalidates a San Antonio “fair notice” ordinance, saying its requirement that contractors file additional paperwork or risk losing vested property rights violated state law.

The Fourth District Court of Appeals said the city ordinance, passed in 2006, “effectively redefines” the manner in which state lawmakers set out to determine vested property rights and had the potential to wholly preclude recognition of rights the state said had vested in property owners.
