Dish Harassment Suit Belongs In Arbitration, Court Says

Law360, Los Angeles (November 26, 2013, 3:59 PM EST) -- A New Jersey appeals court on Tuesday ordered a former Dish Network LLC's employee's sexual harassment and unlawful retaliation claims to arbitration, finding that the plaintiff waived her rights to trial through a clear, unambiguous arbitration agreement. 

In an unpublished opinion, a two-judge panel reversed a lower court's decision denying Dish's motion to compel arbitration and to dismiss Theresa Jones' complaint. The panel said Jones' arguments that her arbitration agreement with Dish is unenforceable are unconvincing.
