Employers Win Class Waiver Battle, But War Isn't Over

Law360, New York (December 3, 2013, 7:43 PM EST) -- The Fifth Circuit handed employers a major victory Tuesday by rebuffing the National Labor Relations Board's ban on employment class waivers, but attorneys say the issue remains far from resolved and eventually will end up at the U.S. Supreme Court.

A divided Fifth Circuit panel rejected the board's conclusion that because an employer cannot require its workers to sign an agreement waiving their rights to bring class or collective employment claims in any forum, homebuilder D.R. Horton had run afoul of the National Labor Relations Act....
