Law360, New York (December 9, 2013, 10:01 PM EST) -- A Ninth Circuit panel on Monday allowed heirs of a Holocaust victim to advance their case to recover an impressionist masterpiece currently in a Spanish museum, ruling California’s six-year statute of limitations for recovering fine art from museums did not intrude on foreign affairs.

The panel overturned a district court dismissal of the case, which had found the state law created remedies specifically for wartime injuries and was too similar to a previous law struck by the Ninth Circuit for singling out Holocaust-era artwork. The current...
