Atty Appeals $4.2M Junk Fax Judgment To Supreme Court

Law360, Chicago (January 3, 2014, 9:14 PM EST) -- An estate planning attorney who was hit with a $4.2 million class action judgment for sending unsolicited fax advertisements has appealed to the U.S. Supreme Court, challenging the Seventh Circuit’s ruling on how the judgment should be distributed.

In a Dec. 23 petition for a writ of certiorari, attorney Gregory Turza said the Seventh Circuit erred in forcing him to pay the full amount of the judgment before any class members other than the plaintiff had submitted claims, and despite its finding that the case didn’t...
