Dish Likens ABC's DVR War To High Court Ruling Over VCRs

Law360, Los Angeles (January 21, 2014, 8:12 PM EST) -- Dish Network LLC on Friday pushed the Second Circuit to deny American Broadcasting Companies Inc.'s attempt to halt Dish's ad-skipping DVR service, arguing that the U.S. Supreme Court previously allowed consumers to tape television broadcasts with VCRs, which also had fast-forward capabilities.

In a partially redacted brief, Dish said the high court's decision in Sony Corp. of America Inc. v. Universal City Studios Inc. didn't toll the death knell for the entertainment industry — and neither will a New York federal judge's ruling in an infringement...
