Law360, New York (January 22, 2014, 2:16 PM EST) -- The Ninth Circuit on Tuesday refused to rehear a case in which it ruled Ernst & Young LLP's arbitration agreement containing a class waiver should be enforced in a proposed wage-and-hour class action.
