Penske Truckers Denied Class Cert. In Unfair-Wage Suit

Law360, New York (January 22, 2014, 4:26 PM EST) -- A California federal court on Tuesday denied class certification to 349 drivers bringing unfair-wage claims against their former employer Penske Logistics LLC, saying the drivers failed to prove that the company prevented them from taking breaks with docked pay. 

The class was certified in 2010, when the Penske drivers — who also performed installation services for Whirlpool Corp. — sued in 2008, claiming the company deducted a 30-minute daily meal break despite the fact that the job often required them to skip lunch. The drivers also...
