9th Circ. Again Axes Fox's Bid To Block Dish 'Hopper' Service
Law360, New York (January 24, 2014, 6:35 PM EST) -- The Ninth Circuit on Friday refused to rehear Fox Broadcasting Co.'s attempt to have the court shut down Dish Network Corp.'s "Hopper" ad-skipping digital video recording service in a copyright infringement battle between the broadcaster and cable service provider.
The same three-judge panel that ruled against Fox in July 2013 stuck to its earlier ruling affirming a district court's denial of Fox's request for a preliminary injunction against Dish's ad-skipping "Hopper" products by unanimously denying Fox's petitions for a panel rehearing and rehearing en banc, according to the order.
