Class Cert. Denied In First American Title Rate Action

Law360, Los Angeles (January 27, 2014, 6:11 PM EST) -- A New Jersey federal judge on Monday denied class certification in a putative class action accusing First American Title Insurance Co. of misrepresenting and inflating title insurance costs charged to homeowners, ruling records needed to ascertain the class are not readily available.  

U.S. District Judge Renee Marie Bumb dismissed the plaintiffs’ motion for class certification, finding First American’s transaction databases do not have all of the information needed to identify class members, and that a file-by-file effort would be needed.
