Wal-Mart Evades TCPA Suit Over Junk Texts

Law360, Chicago (January 29, 2014, 6:28 PM EST) -- The lead plaintiff in a proposed class action accusing Wal-Mart Stores Inc. of sending spam text messages has agreed to drop the suit after settling individually with the retail giant, according to a Tuesday filing in California federal court.

Plaintiff Elizabeth Ibey joined Wal-Mart in a joint motion to dismiss the case and asked that the claims of proposed class members other than Ibey be dismissed without prejudice, leaving the door open for someone else to assert the same claims.
