2nd Circ. Says Stallone Didn't Steal 'Expendables' Script

Law360, New York (February 3, 2014, 3:06 PM EST) -- The Second Circuit on Monday affirmed a lower court's ruling that Sylvester Stallone didn't steal the idea for his action ensemble "The Expendables" from an unproduced screenplay called "The Cordoba Caper."

The appeals court seconded U.S. District Judge Jed S. Rakoff's June 2012 dismissal of Marcus Webb's copyright infringement lawsuit, but for an alternate reason: Rakoff said there was no evidence that Stallone actually copied Webb's script, while the appeals court said they aren't even similar.
