NJ Utility Escapes Mall Developer's Slope Failure Suit

Law360, New York (February 14, 2014, 3:17 PM EST) -- A New Jersey state judge on Wednesday dismissed a long-running $12 million contract dispute over the failure of a hill slope during the construction of a shopping center between the mall's developer and a local water utility.

The dispute arose in 2001 between Elizabethtown Water Co., now known as New Jersey American Water Co., and developer Watchung Square Associates LLC, after a slope on the side of a mountain being excavated failed and delayed construction of the Watchung Square Mall.
