High Court Rebuffs Moldy Washer Class Cert. Appeals

Law360, New York (February 24, 2014, 2:37 PM EST) -- The U.S. Supreme Court on Monday refused to hear Whirlpool Corp., Sears Roebuck & Co. and BSH Home Appliance Corp.’s challenges to class certification rulings in three suits over defective washing machines, even after it wiped out decisions upholding certification in two of the cases last year.

In a short docket order, the nation’s highest court denied Whirlpool, Sears and BSH’s petitions for writ of certiorari in which they had argued that most of the consumers weren't harmed and hadn't met class certification predominancy requirements. ...
