2nd Circ. Ruling Bolsters Pa. 'Reasonable Expectation' Law

Law360, New York (February 24, 2014, 8:14 PM EST) -- The Second Circuit's revival of two former NBA referees' suit over a disability insurance policy strengthens Pennsylvania's "reasonable expectation" doctrine beyond the Keystone State, allowing plaintiffs to potentially redraw policy terms based on how the coverage was explained to them.

A three-judge panel of the Second Circuit, in an opinion penned by Judge Richard C. Wesley, on Monday reversed a Connecticut federal judge's 2012 dismissal of Ronald Nunn and Donald Vaden's allegations that, based on their understanding of a salesman's pitch, a Massachusetts Casualty Insurance Co....
