5th Circ. Rejects BP Bid To Block Spill Payments

Law360, New York (March 3, 2014, 10:38 PM EST) -- A divided Fifth Circuit on Monday denied BP PLC's bid to block businesses that can't trace their losses to the 2010 Deepwater Horizon disaster from recovering money under its $9.2 billion settlement with victims of the spill, ruling the settlement doesn't require claimants to submit evidence of causation. 

In a 2-1 ruling, the appellate panel upheld Judge Carl Barbier's Dec. 24 ruling that the settlement agreement doesn't require certain businesses to establish a causal nexus between their alleged injuries and the oil spill. BP in a...
