9th Circ. Asked To Rehear Suit Over Southwest-AirTran Merger

Law360, New York (March 5, 2014, 8:18 PM EST) -- Air travelers urged the Ninth Circuit on Tuesday to rehear their challenge to the $1.4 billion merger of Southwest Airlines Co. and AirTran Holdings Inc., saying a three-judge panel wrongly concluded they hadn’t suffered any antitrust injuries even though the reduction of competition in the airline industry was injury enough.

The consumers pointed out how the U.S. aviation sector had become increasingly concentrated since 2008 — with the number of major U.S. airlines dropping from seven to four — and cited the Supreme Court’s previous findings...
