USAF Contractor Can't Shake FCA Suit Alleging $50M Scam

Law360, Los Angeles (March 6, 2014, 8:48 PM EST) -- A Texas federal judge refused Thursday to toss a qui tam complaint accusing a U.S. Air Force contractor of cheating the government out of $50 million, after deciding the company may have known about the wrongdoing alleged by an ex-employee.

Denying GSD&M Idea City LLC's motion for summary judgment, U.S. District Judge Reed O'Connor found genuine factual disputes over whether there was a false statement or fraudulent course of conduct, whether the defendant had the requisite scienter, and whether its alleged false statements were material....
