2nd Circ. Reins In Judges' Discretion On ERISA Lawyer Fees

Law360, New York (March 12, 2014, 3:22 PM EDT) -- In a ruling designed to guide future judges, the Second Circuit on Tuesday reversed a federal judge who declined to award attorneys' fees to a lawyer who had won summary judgment for a client seeking disability from his insurer after a heart surgery complication. 

Once plaintiff John J. Donachie, guided by counsel Michael F. Mongelli II, succeeded on the disability pay question, they became eligible for attorneys' fees under the U.S. Supreme Court's 2010 Hardt v. Reliance Standard Life Ins. Co. decision, the Second Circuit said.  ...
