Lufthansa Can't Ground Suit Over Unatoned Cancellations

Law360, New York (March 17, 2014, 1:10 PM EDT) -- An Illinois federal judge on Friday refused to toss a proposed class action accusing Deutsche Lufthansa AG of failing to properly compensate passengers for certain delayed or canceled flights departing from or arriving in the European Union.

U.S. District Judge Sharon Johnson Coleman rejected Lufthansa’s arguments that the only enforceable contract that plaintiffs Pavel and Ilona Polinovsky entered into on their canceled British Airways flight from Atlanta to London, with a connecting flight to Warsaw, Poland, was with that airline.
