FreshDirect's OT, Tips Policy Rotten, Delivery Drivers Say

Law360, New York (March 24, 2014, 7:37 PM EDT) -- Four former drivers for Fresh Direct LLC accused the grocery delivery company in a class action made available Friday of violating federal and state law by withholding more than $23 million in overtime wages and tips per year from drivers.

The ex-drivers sued Fresh Direct and co-founders David McInerney and Jason Ackerman, who is also the company's CEO, in federal court in New York, saying the company’s delivery charge is a gratuity under New York labor law and drivers are entitled to it. The drivers also...
