Starbucks Baristas Lose Class Cert. Bid In Wage Action

Law360, Los Angeles (March 24, 2014, 4:06 PM EDT) -- A California federal judge on Monday refused to certify four proposed classes in a suit alleging Starbucks Corp. did not allow for required rest breaks or meal periods, finding that each of the proposed classes were overinclusive.

U.S. District Judge Michael W. Fitzgerald ruled that named plaintiff Nicole Cummings had not shown that Starbucks’ depriving of meal and rest breaks had been uniformly applied to employees other than herself.
