Wellbutrin Drug Cos. Were Anti-Competitive: Suit

Law360 (April 4, 2008, 12:00 AM EDT) -- A drug distribution company has filed a proposed antitrust class action against Biovail Corp. and GlaxoSmithKline Corp. alleging that the two companies filed frivolous patent lawsuits to keep a generic version of antidepressant Wellbutrin XL from reaching the market.

The lawsuit, which was filed by American Sales Company Inc. Wednesday in the U.S. District Court for the District of Massachusetts, said the companies engaged in “sham litigation and petitioning and entered into anti-competitive agreements to improperly maintain their monopoly profits.”
