Fry's Bounces FLSA Class Action To Federal Court

Law360, New York (April 8, 2008, 12:00 AM EDT) -- Retailer Fry’s Electronics Inc. has moved from California state court to federal court a proposed wage-and-hour class action filed against it, claiming the district court has jurisdiction over the suit because the complaint “poses at least two federal questions.”

Fry’s filed a notice of removal on Friday in the U.S. District Court for the Northern District of California, effectively removing the putative class action from the Superior Court of the State of California for the County of Santa Clara, where it was first filed on Feb....
