NYSRA Dealt Heavy Blow In Calorie War

Law360, New York (April 30, 2008, 12:00 AM EDT) -- A three-judge panel of the U.S. Court of Appeals for the Second Circuit has denied the stay request of the New York State Restaurant Association, paving the way for the city to begin enforcing its calorie posting regulation while awaiting the larger appeal of its proposed health initiative.

Late Tuesday, Judges Chester Straub, Rosemary Pooler and Sonia Sotomayor issued a denial of the full stay after hearing arguments from both sides on the bid earlier that morning.
