Bausch & Lomb Told To Turn Over Disputed Docs

Law360, New York (May 9, 2008, 12:00 AM EDT) -- A special master in the Bausch & Lomb Inc. contact-solution multidistrict litigation has told the company to turn over documents it had argued were protected by attorney-client privilege.

Special Master Daniel J. Capra said Thursday that the company needs to turn over several documents, but he also said some exhibits could be kept private and allowed redactions.

Capra found that part of a draft of a PowerPoint presentation before the U.S. Food and Drug Administration is privilege, but part isn't.
