Law360, New York (June 2, 2008, 12:00 AM EDT) -- A permanent injunction will remain in place barring Fresenius Medical Care AG from selling a kidney dialysis machine found to have infringed three patents, after the U.S. Court of Appeals for the Federal Circuit on Monday denied the company's bid to have the injunction stayed pending appeal.
In 2007, a jury found that the 2008K hemodialysis machine manufactured by Fresenius infringed patents held by Baxter International Inc. The two companies are described in court papers as “arch rivals in the renal field.”
