1st Circuit Upholds 'Don’t Ask, Don’t Tell' Rule

Law360 (June 10, 2008, 12:00 AM EDT) -- A federal appeals court has thrown out a challenge to the U.S. military's “Don't Ask, Don't Tell” policy, creating a split between circuit courts.

Just weeks before the U.S. Court of Appeals for the First Circuit dismissed the appeal Tuesday, the U.S. Court of Appeals for the Ninth Circuit partially reversed a ruling upholding the suspension of an Air Force reservist nurse and called for further scrutiny of the 1993 Don't Ask, Don't Tell Act.
